Locknob.com is owned and operated by Specialty Hardware, LLC ("Specialty
Hardware").
THIS AGREEMENT CONTAINS THE TERMS AND CONDITIONS THAT APPLY TO YOUR
USE OF THIS WEBSITE (the "Site") AND YOUR PURCHASE FROM
SPECIALTY HARDWARE OF THE PRODUCTS (the "Products") NAMED
HEREIN, WHICH ARE SOLD IN THE UNITED STATES. PLEASE READ THIS DOCUMENT
CAREFULLY AS IT CONTAINS VERY IMPORTANT INFORMATION ABOUT YOUR RIGHTS
AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY
TO YOU.
BY PLACING AN ORDER, YOU ACKNOWLEDGE THAT YOU HAVE READ, ACCEPTED,
AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS, AND TO COMPLY WITH
APPLICABLE LAWS AND REGULATIONS. THESE TERMS AND CONDITIONS APPLY
UNLESS: (i) YOU HAVE SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT
WITH SPECIALTY HARDWARE, OR (ii) OTHER SPECIALTY HARDWARE STANDARDS
TERMS APPLY TO THE TRANSACTIONS. THESE TERMS AND CONDITIONS ARE SUBJECT
TO CHANGE WITHOUT PRIOR WRITTEN NOTICE AT ANY TIME, AT THE SOLE DISCRETION
OF SPECIALTY HARDWARE.
Orders
Our goal is to ship in-stock items within forty-eight (48) hours
of order receipt. All back-ordered items will be shipped upon receipt
unless canceled by the customer. Most back-order items will usually
be shipped within three business days of the order. We will notify
customers if Products will not be shipped within three business days
after receipt of an order and will give the customer the option to
cancel the order.
Pricing, Acceptance and Payment Terms
Our goal is to provide you with the most accurate and up-to-date
product information available. However, in the event that a typographical
error or erroneous information received from the supplier results
in an incorrect product price, Specialty Hardware shall have the
right to refuse or cancel an order placed for that product, whether
or not it has been confirmed and your credit card charged. If your
credit card has been charged for the purchase and Specialty Hardware
cancels your order, Specialty Hardware shall promptly issue a credit
to your credit card in the amount of the incorrect price.
All orders will be billed at the prevailing price on the date that
the order is placed. Prices are subject to change at any time without
notice. All errors and omissions are subject to correction, and Specialty
Hardware reserves the right to reject any sale for any reason, including
for an incorrect price quotation or advertisement. Your total price
for the Products will be stated on your purchase receipt. Prices
advertised do not include shipping and handling charges or applicable
sales taxes, which will be added to the price that you pay, unless
you provide to Specialty Hardware the valid and correct tax exemption
certificate applicable to the Product ship-to location prior to acceptance
of the order.
Orders are not binding upon Specialty Hardware until accepted by
Specialty Hardware. Your receipt of an order confirmation does not
signify our acceptance of your order, nor does it constitute confirmation
of our offer to sell a product. Specialty Hardware reserves the right
at any time after receipt of your order to accept or decline it for
any reason. Specialty Hardware also reserves the right to supply
less than the quantity ordered of any item without notifying you
first.
Terms of payment are within Specialty Hardware=s sole discretion,
and unless otherwise agreed to by Specialty Hardware, payment must
be received by Specialty Hardware prior to Specialty Hardware=s acceptance
of an order. Customers on open account will be furnished an invoice
with each order, which are net tenth (10th) of the month. Other methods
of payment for the Products shall be by credit card (i.e., Visa,
MasterCard, American Express or Discover), debit card (issued by
Visa or MasterCard), money order, certified check, COD, or other
prearranged payment method.
Freight and Title
Specialty Hardware will arrange shipping of the Products to your
address. Orders are shipped from our Ridgeland, Mississippi warehouse
by UPS ground. Next day air, second day air, and three-day select
shipping is available upon request. Orders will be shipped freight
prepaid and added to the invoice.
Title to the Products passes to you upon delivery to the carrier
and risk of loss passes to you upon delivery to your address. The
separate charges for shipping and handling will appear on Specialty
Hardware=s invoice.
Credits and Returns
You must examine the Products upon receipt. If any item is damaged
or missing, you must notify Specialty Hardware at once. All billing
credits and return of goods authorization requests must be initiated
within ten (10) days of receipt of materials. Specialty Hardware
must be notified of damage and/or shortages within five (5) days
of receipt of materials. No return of goods will be accepted unless
authorized in advance by Specialty Hardware. Stock items may be
returned free of charge and the customer is responsible for all
shipping charges. Non-stock items may be subject to a restocking
fee up to 30% of returned product cost or may possibly not be returned
due to terms and conditions of manufacturer. Items may be returned
on the following conditions:
(1) The product was purchased within the last thirty (30) days;
(2) A copy of the packing list and/or invoice is required with all
return shipments;
(3) All returned Products must be in their original packaging and
in resellable condition;
(4) All Products must be repacked to assure no damage during shipping;
and
(5) All credits are based upon inspection.
Failure to follow any of the above steps may result in additional
restocking charges or delay/refusal of credit.
Limited Warranties
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE
OTHER RIGHTS WHICH VARY FROM STATE TO STATE. THE LIMITED WARRANTY
APPLICABLE TO THE PRODUCTS IS INCLUDED IN THE DOCUMENTATION ALONG
WITH THE PRODUCTS. SPECIALTY HARDWARE HEREBY EXPRESSLY DISCLAIMS
ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT
LIMITATION, WARRANTIES OF QUIET ENJOYMENT AND NON-INFRINGEMENT, AND
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR
PURPOSE. SPECIALTY HARDWARE MAKES NO EXPRESS WARRANTIES EXCEPT THOSE
STATED IN THIS SECTION AND IN SPECIALTY HARDWARE=S APPLICABLE LIMITED
WARRANTY STATEMENT IN EFFECT THE DATE OF THE INVOICE. ANY SUCH WARRANTIES
WILL BE EFFECTIVE, AND SPECIALTY HARDWARE SHALL BE OBLIGATED TO HONOR
ANY SUCH WARRANTIES, ONLY UPON SPECIALTY HARDWARE=S RECEIPT OF PAYMENT
IN FULL FOR THE ITEM TO BE WARRANTED. SPECIALTY HARDWARE=S MAXIMUM
LIABILITY SHALL BE LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS,
AND IN NO EVENT SHALL SPECIALTY HARDWARE BE LIABLE FOR ANY CONSEQUENTIAL,
INDIRECT, INCIDENTAL, PUNITIVE OR SPECIAL DAMAGES OF ANY NATURE ARISING
FROM THE SALE OR USE OF THIS PRODUCT, WHETHER IN CONTRACT, TORT,
STRICT LIABILITY OR OTHERWISE. WRITTEN INFORMATION, PHOTOGRAPHS,
ADVERTISEMENTS OR ADVICE GIVEN BY SPECIALTY HARDWARE, ITS AGENTS
OR ITS EMPLOYEES SHALL IN NO WAY CREATE A WARRANTY OR IN ANY WAY
INCREASE THE SCOPE OF THIS AGREEMENT.
Goods are warranted against defects in manufacture according to the
manufacturer=s stated warranty. Products will not be accepted for
replacement under this warranty unless we have given prior authorization
for their return. Upon receipt of Products returned for replacement
we will determine whether such Products qualify for replacement under
this warranty; if they do not, we will notify our customer of estimated
costs of replacement involved and will obtain authorization prior
to proceeding.
THE LOCKNOB.COM SITE, INCLUDING THE CONTENT, INFORMATION, MATERIALS
AND OPERATIONS OF THE SITE, IS PROVIDED AAS IS@ WITHOUT WARRANTIES
OF ANY KIND, EITHER EXPRESS OR IMPLIED. SPECIALTY HARDWARE DISCLAIMS
ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO,
WARRANTIES OF QUIET ENJOYMENT AND NON-INFRINGEMENT AND IMPLIED WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT,
TITLE, MERCHANTABILITY OF INFORMATIONAL CONTENT. SPECIALTY HARDWARE
DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE OPERATION
OF THIS SITE, THE USE, VALIDITY, ACCURACY OR RELIABILITY OF, OR THE
RESULTS OF THE USE OF THE MATERIALS IN THIS SITE OR ANY OTHER SITES
LINKED TO THIS SITE. THE MATERIALS ON THIS SITE MAY BE OUT OF DATE,
AND SPECIALTY HARDWARE MAKES NO COMMITMENT TO UPDATE THE MATERIALS
AT THIS SITE.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE,
SHALL SPECIALTY HARDWARE, ITS SUPPLIERS OR OTHER THIRD PARTIES MENTIONED
ON OR IN THIS SITE BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL
OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF
PROFIT ARISING OUT OF THE USE OR THE INABILITY TO USE THE MATERIALS
ON THIS SITE, EVEN IF SPECIALTY HARDWARE OR A REPRESENTATIVE OF SPECIALTY
HARDWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF
YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING
OR REPAIRS, YOU ASSUME ANY COSTS THEREOF. SOME STATES DO NOT ALLOW
THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,
SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
Sales Tax
Specialty Hardware will apply sales tax for orders to be delivered
to Mississippi addresses. Each customer shall be solely responsible
for all sales or other taxes on orders shipped elsewhere.
Privacy Policy B Information Collection
When a credit card number is supplied for a purchase, this information
is used internally exclusively to process payment for your order
and is not shared in any form with outside parties with the exception
of any credit card validation service.
Privacy Policy B Information Use
If you provide us with your E-mail address, we may upon occasion
send you E-mail offers. Your E-mail address will not be shared with
any outside parties.
Your Acceptance of These Terms
By using this Site, you signify your agreement to all of the Specialty
Hardware terms and conditions. If you are not in agreement with these
policies, please discontinue the use of this Site. We reserve the
right, at our discretion, to change, modify, add, or remove portions
of this policy at any time. Please check this page periodically for
changes. Your continued use of this Site following the posting of
changes to these terms is an acknowledgment of your acceptance of
these changes.

may NOT be altered, supplemented or amended by the use of any other
document(s).

only and do not form a part of these terms and conditions, and no
construction or interference shall be derived therefrom.
Severability
If any provision of these terms and conditions shall be ruled unenforceable,
the remainder shall be enforced to the extent permissible.
